In a November 23, 2023, Consent Order, Kenneth Kapusniak, P.Eng., admitted that he demonstrated unprofessional conduct in relation to the engineering services he provided for the design of two precast concrete parking structures in Courtenay and Campbell River, BC. As of December 1, 2023, Mr. Kapusniak’s registration with Engineers and Geoscientists BC is suspended for a period of 6 months.

In 2015, Mr. Kapusniak provided engineering services related to two precast concrete parking structures located in Campbell River, BC, and Courtenay, BC (the Projects). Mr. Kapusniak signed and sealed design drawings for the Projects that did not comply with the BC Building Code 2012 (BCBC 2012).

In the Consent Order, Mr. Kapusniak admitted that he demonstrated unprofessional conduct related to the Projects and that he acted contrary to the Bylaws of Engineers and Geoscientists BC. Mr. Kapusniak agreed that, among other things, he failed to:

  • ensure the load bearing spandrel beams for the Projects met the strength requirements of the BCBC 2012;
  • confirm the structural system for the Projects provided the adequate strength to resist seismic forces including adequate member strength, connection strength, and a complete and sufficient load path to transfer the required seismic loads to the foundation; and
  • failed to ensure for each of the Projects that an independent review of the design was completed and properly documented prior to construction.
As outlined in the Consent Order, during the suspension period, Mr. Kapusniak must successfully complete and pass the Engineers and Geoscientists BC Professional Practice Examination and a structural engineering educational course. Within six months of his reinstatement, Mr. Kapusniak must undergo a practice review conducted by the Engineers and Geoscientists BC Audit and Practice Review Committee.

Mr. Kapusniak paid $18,000 toward the legal and investigative costs of Engineers and Geoscientists BC.
